By accessing and using MCPinator (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, you should not use this Service.

2. Description of Service

MCPinator is a web-based client for interacting with Model Context Protocol (MCP) servers. The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind.

3. User Responsibilities and Liability

YOU ASSUME ALL RESPONSIBILITY AND LIABILITY FOR:

• Any and all use of the Service
• Any data, commands, or requests you send through the Service
• Any connections you make to third-party MCP servers
• Any damage, data loss, or security breaches resulting from your use of the Service
• Ensuring you have proper authorization to connect to and interact with any MCP servers
• Compliance with all applicable laws and regulations
• The security and confidentiality of your account credentials

4. Testing and Development Tool

MCPinator is intended FOR TESTING AND DEVELOPMENT PURPOSES ONLY. This Service is NOT intended for:

• Production use
• Processing sensitive or confidential data
• Mission-critical applications
• Systems where security or data integrity are paramount

5. No Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GARAGE274, LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO:

• The operation of the Service
• The accuracy, reliability, or completeness of any information obtained through the Service
• The security of data transmitted through the Service
• The availability or uptime of the Service
• The compatibility with any particular MCP server or system

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GARAGE274, LLC SHALL NOT BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption
• Security breaches or unauthorized access to your systems
• Errors, omissions, or inaccuracies in any information
• Damage caused by connecting to malicious or compromised MCP servers
• Any other loss or damage of any kind arising out of or in connection with your use of the Service

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Garage274, LLC has been advised of the possibility of such damage.

7. Indemnification

You agree to indemnify, defend, and hold harmless Garage274, LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Any data or commands you transmit through the Service

8. Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use of your account

9. API Keys and Third-Party Services

When you store API keys or credentials for MCP servers:

• You are solely responsible for the security of these credentials
• You assume all risk associated with storing credentials in the Service
• Garage274, LLC is not responsible for any unauthorized access or misuse of your credentials
• You must ensure you have proper authorization to use any API keys or credentials

10. Prohibited Uses

You may not use the Service to:

• Violate any local, state, national, or international law
• Transmit malicious code or compromise system security
• Attempt to gain unauthorized access to any systems or networks
• Interfere with or disrupt the Service or servers connected to the Service
• Process personal data in violation of privacy laws

11. Termination

Garage274, LLC reserves the right to terminate or suspend your access to the Service at any time, without notice, for any reason, including but not limited to violation of these Terms of Service.

12. Changes to Terms

Garage274, LLC reserves the right to modify these Terms of Service at any time. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Garage274, LLC operates, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Service constitute the entire agreement between you and Garage274, LLC regarding the use of the Service.
